Renters' right act

The Renters’ Rights Act 2025 is expected to come into effect from 1 May 2026 and will impact the off-campus student accommodation. 

Please see Gov.uk for up-to-date accurate and exact information on the Act. We’ve highlighted the following main points to share with you: 

Any AST’s that are currently valid will automatically change to an Assured Periodic Tenancy, meaning there is no end date.  

Tenants can leave with 2 months notice.  If you have a group tenancy and 1 student gives 2 months notice, this would end the tenancy for all students in the group. 

Tenants have the right to request a pet.  A landlord can refuse a pet, if the refusal is reasonable. Landlords cannot enforce blanket bans, must consider requests on a case-by-case basis, and have 28 days to respond in writing. Valid reasons for refusal include unsuitable property size, pet allergies, or leasehold restrictions. 

Rents can only be increased once a year and must be done using an official Section 13 notice.  Landlords will need to give 2 months notice of any rent increase. 

The maximum amount that can be requested will be 1 months rent in advance. 

This allows landlords to evict student tenants between 1 June and 30 September.  Please note the following in order toto use this 

The landlord must inform the tenants in writing before they sign the tenancy agreement that they intend to use this Ground 4A.  However, this cannot be more than 6 months before the start of the tenancy 

  • Tenants must be full time students during the tenancy 
  • The landlord must provide 4 months notice
  • The landlord can only use this if they intend to re let the property to another student
