LAW 40094 Termination of the employment relationship- unfair and wrongful dismissal
Available on a modular basis this module will appeal to HR professionals, recent graduates from different disciplines but also junior lawyers interested in developing expertise in this area of legal work. This module provides a practical legal insight into the area of employment tribunal practice and procedure. Using an extended case study, analyse the progression of a case through the tribunal. Integrating practical legal drafting, negotiation and advocacy this module will allow you to enhance your knowledge and understanding of the law (both caselaw and statute) and procedure whilst developing practical legal skills.
Aims
To provide a practical legal insight into the area of employment tribunal practice and procedure. Using an extended case study, analyse the progression of a case through the tribunal. Integrating practical legal drafting, negotiation and advocacy this module allows students to enhance their knowledge and understanding of the law and procedure whilst developing practical legal skills.
Intended Learning Outcomes
Critically evaluate the procedure and legal requirements for the commencement of a claim in the Employment Tribunal: 1Critique a draft claim, identifying the strengths and weaknesses of the claim with a tactical approach to the litigation: 1Critically analyse the alternative methods of dispute resolution and communicate them in a form accessible to a lay or professional client: 1Outline the procedural stages in a disputed claim, identifying the strengths and weaknesses of a developing claim and communicate them in an appropriate form to a lay client.: 1Critically evaluate the appropriate remedies in the event of a successful claim and calculate a schedule of loss and the likely quantum.: 1Use established models of reflective practice such as Moon and Gibbs, reflect on their own personal and professional development: 2
