Ordinance XXX: Removal of Officers and Members Procedure
1. Any proposal (which must be made or supported by at least 2 members of the Council) that a member of the Council (other than the Pro Chancellor) should be removed as a member of the Council under section 34 of the Statutes shall be presented to the Pro Chancellor (or if the proposal is made or supported by the Pro Chancellor, a Deputy Pro Chancellor) who shall consider it and may direct that the matter be heard by a special committee of members of the Council, to be called "the Special Committee". A Deputy Pro Chancellor may not make or support a proposal which is made or supported by the Pro Chancellor.
2. Any proposal (which must be made or supported by at least 2 members of the Council who are not Deputy Pro Chancellors) that the Pro Chancellor should be removed as a member of the Council under section 34 of the Statutes shall be presented to a Deputy Pro Chancellor who shall consider it and may direct that the matter be heard by a special committee of members of the Council, to be called "the Special Committee".
3. The Pro Chancellor shall appoint the members and nominate the Chair of the Special Committee, unless the Special Committee is meeting to decide on removal of the Pro Chancellor or on a removal proposed by the Pro Chancellor. If the Special Committee is meeting to decide on removal of the Pro Chancellor or on a removal proposed by the Pro Chancellor, the Deputy Pro Chancellor who directed on the hearing shall appoint the members and nominate the other Deputy Pro Chancellor as the Chair of the Special Committee.
4. If a decision on removal is to be made about a Lay Member of the Council, the Special Committee shall comprise 3 Lay Members of the Council. If a decision on removal is to be made about a member of the Council who is employed by the University or who is a student of the University, the Special Committee shall comprise 2 Lay Members of the Council and 1 member of the Council who is employed by the University.
5. The Chair of the Special Committee shall decide upon its process. The member of the Council who proposed the removal shall present a case to the Special Committee in favour of the removal. The person who it has been proposed should be removed shall have the opportunity to present a case against his or her removal to the Special Committee. The person who it has been proposed should be removed shall have the right to hear any presentation of the case in favour of the removal. The person who it has been proposed should be removed may be accompanied by a member of the University as defined by Statute 2 willing to act as his/her friend or representative at the hearing; in the case of a lay member this is restricted to other lay members of Council.
6. The Special Committee shall decide on the removal. The Special Committee shall report its decision and reasons to the Council and to the person who it has been proposed should be removed. The decision of the Special Committee shall take effect immediately.
7. The Special Committee shall have a quorum of two members.
