Description

Building on the foundations of Equity 1, Equity 2 continues to focus upon
the development, role and significance of Equity and equitable principles
in a variety of contexts. It also promotes a sound understanding of
general equitable principles and refines, through research and problem
solving, the ability to deal with the technicalities of the substantive
law of equity and equitable remedies.

Aims

Together with Equity 1, to provide a coherent overview of the central role of the equitable jurisdiction in private law, including in particular in this module, the nature of a trustee's duties and breaches thereof and related equitable remedies, both personal and propriety.

Intended Learning Outcomes

To appreciate the particular nature of the fiduciary relationship between trustee and beneficiary.
To understand the nature of a trustee's duties, how they may be breached and with what consequences.
To understand the essence of equitable relief in the form of injunctions, specific performance and tracing.
