Description

Equity & Trusts introduces the student to the development, role and
significance of Equity and equitable principles. It also promotes a sound
understanding of general principles of trust law and refines, through
research and problem solving, the ability to deal with the technicalities
of the substantive law of equity and trusts.

Aims

Together with Equity 2, to provide a coherent overview of the central role of the equitable jurisdiction in private law, including in particular in this module, the nature of trusts and the rules and formalities concerning the constitution of trusts and charities.

Intended Learning Outcomes

To acquire an overview of the historical, ethical and jurisprudential influences on the development of the role of equity.
To comprehend the nature of trusts (including trusts of co-ownership) and their relationship to land law.
To understand the nature of charities, their relationship to trust principles and the Cy-pres doctrine
