LAW-10039 (Legal Essentials)
Introduction to Real Property develops knowledge acquired in Introduction to Property Law (LAW-10037) at Level 4 with a focus on third party rights in Land. As one of the key foundations of legal knowledge, this module is essential in providing you with the skills and confidence to apply and critique legal rules and formalities as apply to the creation, protection and disposition of third-party rights in Land. It is an essential module for all students wishing to pursue a career in legal practice and brings to life the world of property law disputes in practice.
Aims
The Law of Real Property module builds on knowledge acquired at Level 4 in Introduction to Property (LAW-10037) and examines the major types of third-party property interests that may exist in land. Students will consider in depth how property rights are acquired, protected and transferred. Leases and licences will be examined and students will acquire an understanding of the role of covenants within leases. Students will explore the rules relating to the creation of easements, the transmission of the benefit and burden of freeholdcovenants, the statutory formalities and policy drivers governing land contracts and the legitimate means by which these formalities can be circumvented. The law of mortgages will be analysed with special attention to the statutory, common law and equitable rights and remedies of the parties.

Description of Module Assessment
1: Open Book Examination weighted 100%Online, open-book assessmentThe word limit for the assessment is 2,500 words. Students must answer two questions from a choice of problem scenarios. The questions carry equal weight and are not pre-seen.
The paper will be released at 9am on the morning of the assessment. Students will have 28 hours to submit their answers. Although 28 hours has been allocated as the window within which answers must be completed, we expect that most students will take no more than 4 hours to complete their answers. Answers must be completed and submitted in accordance with the Law School approved rubric for online open-book assessment.
